How do I get my money back from a Ferguson Custom Sawmill LLC? How do I stop this from happening to others? How do I stop being a Victim of Contractor Fraud? Here is my husbands letter to Kyle Ferguson of Ferguson Custom Sawmill LLC after taking my money and broken contract...

Kyle,

   I wanted to keep my mouth shut, but I have decided against it. Im going to bullet point the areas you screwed us on because you are obviously more interested in making excuses than in accepting responsibility for ripping off a woman.

 1) You never finished cutting the trees you were paid to cut. You never cleared the areas you were paid to clear. In fact the crooked post lines installed by you and your crew are even run in half-circles around the trees you left rather than doing what you were paid to do.

 2) Every line run by your crew is crooked the boards can't even mate to them. There is caverns in the holes and the posts were never tamped or set. The dirt was thrown over the top to cover it up and hustle a next payment out of us.

 3) You promised 8 weeks (i have the email) and drug it out for 6 months. On the last payment you promised us completion in 3 weeks. 6 weeks later all that was done was the work our children did. Our $45k in oak timber cut from our trees is rotting in piles on the ground.

 4) The boards put on by your crew were all crooked, had inadequate fasteners and are already falling apart. It is half ass work start to finish.

 5) Your trailer is going to cost me $2k to have hauled off. Thats what we get for paying 6 months of water and electric while you screwed us. Thats what we get for being nice. You have no gas to work here and no gas to get your trailer but you somehow have gasoline enough to drive here and sneak in like a thief in the night to get the bobcat forks. You think i want them? Were they moved from the place you left them?

 6) you took my diesel and never replaced a drop. You took my rental funds and never gave it back. You hustled my wife out of the last payment knowing you were ripping us off. You made promise after promise and never kept one.

 7) You never did deliver all our millings. Many of the boards are garbage cuttings. Many posts were lost due to bad cuts or were put in the fence line in unequal spacing. The whole operation was unorganized and not thought out.

 

8) Out of the six months, we got two weeks in which we actually received the  40 hours of work week you were contracted to provide. Your equipment breaking is sad, but isn't your customers problem. You made it our problem and expected to get paid for it.

 

9) You used pictures of our job all over the place to drum up business, but all the finished product pictures are work done by me and my sons. You told us you were going out of business and broke? Well, give us $5k of our money back or give me the mill so I can use it to finish your job. Either way, at least try to make your actions the actions of someone with integrity.

 

10) You wanted out of this and you screwed us. If you do not attempt to make this right, we will share our experience with everyone on craigslist and Facebook, as well as the BBB and other legal routes.  We have every text and email. I have kept my wife from acting but the more time i spend doing what we paid you to do, the more disgusted i get.
